La Constitución mexicana y el arbitraje comercial

Abstract

The fact that the State of Mexico has the exclusive privilege of the jurisdiction is not an obstacle for citizens to supply this activity with others private procedures if they are voluntary accepted even if it is a res iudicata matter. The arbitration does not suppose a substitution of the exclusive jurisdictional function of the State, neither a lack of this function inherent to sovereignty. The Mexican legal order admits the possibility for citizens to choose the solution for their social and legal problems between the jurisdictional and non-jurisdictional way. mainly the arbitration. The right of every citizen to obtain a due process of law from judges and tribunals exercising their rights and interests is not an obstacle to choose a non-jurisdictional solution.

El hecho de que el Estado mexicano se reserve el monopolio de la jurisdicción, no impide a los particulares que sustituyan dicha actividad a través de procedimientos de carácter privado, cuando estos últimos sean admitidos de forma voluntaria, incluso con fuerza de cosa juzgada. El empleo del arbitraje no supone una usurpación de las funciones jurisdiccionales que corresponden al Estado o, si se quiere, un desentendimiento por parte de éste de la función jurisdiccional inherente a su soberanía. El ordenamiento mexicano concede a los particulares la posibilidad de optar para la solución de sus problemas socio-jurídicos entre el cauce o vía jurisdiccional y el extrajudicial, señaladamente el arbitraje. El derecho que todo ciudadano tiene a obtener la tutela efectiva de los jueces y tribunales en el ejercicio de sus derechos e intereses legítimos, no impide la facultad de optar para dicha tutela al cauce extrajudicial.
