Análisis de las resoluciones de la Agencia Española de Protección de Datos de tutela de derechos de acceso, rectificación, cancelación y oposición en el ámbito sanitario en el período 2010-2014

Abstract

El derecho fundamental a la protección de datos es el derecho que tiene toda persona a controlar su información personal. Los derechos de acceso, rectificación, cancelación y oposición forman parte esencial de este derecho. Los datos personales de salud son datos especialmente sensibles y son objeto de reforzamiento de medidas para su garantía y protección. El ejercicio de los derechos de acceso, rectificación, cancelación y oposición de datos personales de salud en el ámbito sanitario adquiere relevancia al referirse al contenido de la historia clínica de cada persona y su Tutela es ejercida por las Agencias de Protección de Datos OBJETIVOS GENERAL Efectuar la caracterización de las resoluciones de la Agencia Española de Protección de Datos sobre la tutela de Derechos de Acceso, Rectificación, Cancelación y Oposición de datos personales de salud en Entidades, Instituciones, Organismos o Empresas relacionadas con la Asistencia Sanitaria e identificar las variables principales asociadas con esas resoluciones durante el periodo 2010-2014. ESPECÍFICOS 1. Conocer las características fundamentales de las resoluciones, considerando todas las variables del estudio. 2. Evaluar la tendencia temporal de las resoluciones y los derechos. 3. Analizar los tiempos de espera para la resolución. 4. Establecer las posibles asociaciones entre las variables del estudio y los tipos de resolución. 5. Efectuar un análisis de contenido de las resoluciones desestimadas e inadmitidas. 6. The rights to access, correct, delete and object to such information form an essential part of this right. Personal information on health is a particularly sensitive type of information and is subject to reinforced measures to ensure that it is safeguarded and protected. Exercising the rights to access, correct, delete and object to personal health information in the field of health care is even more important because it involves the contents of each individual’s clinical record, and the Protection thereof is performed by the Information Protection Agencies. OBJECTIVES GENERAL To perform a full description of the decisions reached by the Spanish Information Protection Agency regarding the protection of the Rights to Access, Correct, Delete and Object to personal health information (referred to herein as “ARCO” rights) at Entities, Institutions, Bodies or Companies related with health care and to determine the main variables associated with those decisions throughout the period of 2010-2014. SPECIFIC 1. To ascertain the fundamental characteristics of decisions reached on personal information claims/complaints, considering all of the study variables. 2. To evaluate the time trend of such decisions. 3. To analyse the waiting times for decisions. 4. To determine potential relationships between the study variables and decision types. 5.
