La digitalización del trabajo: las transformaciones tecnológicas y el régimen jurídico del trabajo digital en Brasil y España

Abstract

Esta tesis, titulada “LA DIGITALIZACIÓN DEL TRABAJO: LASTRANSFORMACIONES TECNOLÓGICAS Y EL RÉGIMEN JURÍDICO DEL TRABAJODIGITAL EN BRASIL Y ESPAÑA”, examina el impacto de la tecnología y la digitalización en el trabajo desde tres ejes: las transformaciones en el trabajo y en la organización de la actividad productiva derivadas del desarrollo tecnológico (como las plataformas digitales) y delas numerosas herramientas digitales, como la inteligencia artificial y los algoritmos (primer capítulo); el análisis de las notas de la relación de empleo en la sociedad digital y sus nuevas realidades sociolaborales (segundo capítulo); y el régimen jurídico del trabajo digital, con énfasis en los aspectos relacionados con la ejecución del contrato de trabajo y el ejercicio de la actividad laboral en este mundo digitalizado (tercer capítulo). Para ello, se analizaron las normas española y brasileña que rigen el trabajo digitalizado contemporáneo. Las relaciones laborales modernas se caracterizan por el uso intensivo de la tecnología -que permite trabajar en cualquier momento y desde cualquier lugar- en modelos de organización del trabajo predominantemente digitales, diferentes del paradigma industrial del siglo pasado que inspiró la legislación laboral vigente. Estas irreversibles y exponenciales transformaciones sociales y económicas generan continuas fricciones entre la realidad social y la regulación laboral, especialmente en las notas de la relación laboral. Las nociones y perspectivas convencionales resultan ahora insuficientes y debilitan la noción de empleo, que es sustituida cada vez más por la de trabajadores autónomos. This thesis, entitled “THE DIGITALIZATION OF WORK:TECHNOLOGICAL CHANGES AND THE LEGAL SYSTEM OF DIGITAL WORK INBRAZIL AND SPAIN”, examines the impact of technology and digitalization on work from three points of view: the changes in work and the organization of productive activity arising from technological progress (such as digital platforms) and the countless digital tools, such as artificial intelligence and algorithms (first chapter); the analysis of the elements of the employment relationship in the context of the digital society and its new socio-labor realities (second chapter); and the legal regime of digital work, with an emphasis on aspects related to the execution of the employment contract and the pursuit of the work activity in this digitalized world (third chapter). To this end, the Spanish and Brazilian rules governing contemporary digitalized work were analyzed. Modern work relationships are characterized by the intensive use of technology - which allows work to be done at any time and from anywhere - in models of predominantly digital work organization, which are different from the industrial paradigm of the previous century that inspired current labor legislation. These irreversible and exponential social and economic changes generate continuous tension between social reality and laborregulation, especially regarding the elements of the employment relationship. Conventional concepts and perspectives are now insufficient and are undermining the notion of employment, which is increasingly being replaced by independent workers.
