Una aproximación crítica al sistema regional africano de protección de los derechos humanos

Abstract

Esta tesis titulada “Una aproximación crítica al sistema regional africano de protección de los derechos humanos” desarrolla un análisis crítico sobre el funcionamiento del sistema africano de derechos humanos. En lugar de recurrir a formas de evaluación externas, se centra en examinar la práctica de los derechos humanos tal y como la han configurado los propios pueblos africanos. Para ello, se realiza un análisis exhaustivo de la teoría del sistema regional africano de derechos humanos, basado en la Carta Africana sobre Derechos Humanos y de los Pueblos de 1986, para posteriormente evaluar la práctica y determinar si es coherente con los principios y derechos que consagra la Carta. La revisión de esta práctica se lleva a cabo mediante referencias indispensables a los informes periódicos de los Estados, las observaciones finales emitidas por la Comisión Africana, declaraciones de ONG y los informes de Relatores Especiales. Estos documentos, entre otros, proporcionan una visión detallada de la implementación de los derechos humanos y permiten observar de cerca las dinámicas reales de este sistema en acción. This thesis entitled “A Critical Approach to the African Regional Human Rights Protection System” develops a critical analysis of the functioning of the African human rights system. Rather than resorting to external forms of evaluation, it focuses on examining the practice of human rights as shaped by African peoples themselves. This is done by undertaking a comprehensive analysis of the theory of the African regional human rights system, based on the 1986 African Charter on Human and Peoples' Rights, and then assessing the practice to determine whether it is consistent with the principles and rights enshrined in the Charter. The review of this practice is carried out through indispensable references to periodic state reports, concluding observations issued by the African Commission, NGO statements and reports of Special Rapporteurs. These documents, among others, provide a detailed overview of human rights implementation and allow a close look at the actual dynamics of this system in action.
