Capograssi, "filósofo de Carnelutti", más allá del iusnaturalismo y el iuspositivismo

Abstract

The article analyzes the Viquian and Rosminian use of reason that led Capograssi to overcome the old polemic iusnaturalism vs. iuspositivism, integrating the best of both in his philosophy of juridical experience, which influenced Carnelutti. In it he values the crucial contribution of legal science, articulates history and metaphysical openness of mind, embraces the pedagogy of catastrophe and points to natural law as a “human idea.
