Abstract
El objeto de este estudio es conocer las semejanzas que existen entre los sistemas jurídicos del common law y civil law. Nos centraremos en el mecanismo probatorio del discovery, un mecanismo propio del Derecho americano y expondremos si tiene cabida en Estados pertenecientes al civil law, en concreto en España.
En segundo lugar, se hará una exposición sobre la regulación de este incidente, tanto en Derecho americano como en Derecho británico al igual de la influencia que ha tenido las nuevas tecnologías.
Asimismo, veremos qué ocurre cuando la información que se requiere está en poder de un tercero ajeno a la controversia ¿Es posible requerirle? ¿Y si se encuentra en el extranjero?
Finalmente, expondremos cómo funciona el discovery en un arbitraje internacional mediante el Schedule of Document Production, también denominado Redfern Schedule.
The purpose of this study is to get to know the similarities that exist between the common law and civil law legal systems. We will focus on the evidentiary discovery mechanism and we will study if it can be applied in a civil law State such as Spain. Secondly, an explanation of the discovery’s regulation in American Law and British Law is going to be made in order to expose the impact and effects of new technologies. Moreover, we will see what happens when the request information belongs to a non-party. ¿Is the request likely? ¿And if that person lives abroad? Finally, it‘s important to study how works discovery mechanism in international arbitration proceedings through the Schedule of Document Production called Redfern Schedule as well.
