El impacto de género de la Ley del Divorcio en España

Abstract

La desigualdad económica y patrimonial de las mujeres es un hecho constatado, simplemente comprobando cómo la feminización de la pobreza no deja de expandirse. En este trabajo de investigación nos hemos preguntado cuál es la razón profunda que informa esta realidad, circunscribiendo el estudio a la más cercana y tangible, España, donde los indicadores de igualdad legal han alcanzado un 76,4% en el último Índice Europeo de Igualdad de Género elaborado por el IEGE en 2021, un 1,8% más que en 2020, lo que arroja un resultado de 6,2 puntos más que la media de la UE. La igualdad legal, está arraigada en nuestra sociedad y en el legislador, al menos en la forma; no así en lo relativo al derecho material. Women's economic and wealth inequality is a proven fact, simply by verifying how the feminization of poverty continues to expand. In this research work we have asked ourselves what is the deep reason that informs this reality, limiting the study to the closest and most tangible, Spain, where the legal equality indicators have reached 76.4% in the latest European Gender Equality Index prepared by the IEGE in 2021, 1.8% more than in 2020, which gives a result of 6.2 points higher than the EU average.Legal equality is rooted in our society and in the legislator, at least in form; not so in relation to material law.
