Abstract
Las relaciones jurídicas que han existido históricamente entre los Ayuntamientos y los Puertos marítimos radicados en sus respectivos términos municipales constituye una de las muestras más señaladas de «confrontación administrativa». Sin embargo, el conjunto de las competencias concurrentes que ostentan los Entes Locales y las Autoridades Portuarias sobre el territorio portuario consigue su efectivo encaje en virtud del principio de especialidad lo que determina, en la práctica, una aplicación preferente de la normativa sectorial.
En cuanto al proyecto específico del puerto de Málaga, el mismo constituye un ejemplo señalado de planificación a largo plazo pues la operación comienza a gestarse en los años ochenta del siglo XX, no siendo hasta comienzos de la segunda década del siglo XXI cuando concluye. También de previsión y análisis de las nuevas necesidades de tráfico portuario captando dos tipos de tráfico en expansión: el de contenedores y el de cruceros marítimos en la búsqueda de una mayor economía, eficiencia, productividad y seguridad en las operaciones portuarias. Y finalmente, representa una muestra acabada de confluencia del puerto con la ciudad, en una relación simbiótica que permite un fortalecimiento mutuo.
The legal relations that have historically existed between the City Councils and the Seaports located in their respective municipal boundaries constitute one of the most marked examples of "administrative confrontation". However, the set of concurrent powers held by Local Authorities and Port Authorities over the port territory achieves its effective fit by virtue of the principle of speciality, which determines, in practice, a preferential application of sectoral regulations. As for the specific project for the port of Malaga, it is a strong example of long-term planning, as the operation began to take shape in the eighties of the twentieth century, not being until the beginning of the second decade of the twenty-first century when it concluded. It also forecasts and analyses the new needs of port traffic, capturing two types of expanding traffic: container traffic and maritime cruise ships in the search for greater economy, efficiency, productivity and safety in port operations. And finally, it represents a finished example of the confluence of the port with the city, in a symbiotic relationship that allows for mutual strengthening.
