Abstract
La Comunicación oral y no verbal son muy importantes a la hora de realizar el análisis del testimonio de un juicio, ya que nos ayuda a realizar lo que los expertos llaman Criminal Profiling o Perfilación Criminal. Concepto utilizado tanto en los Cuerpos y Fuerzas de Seguridad como en el ámbito judicial (abogados, fiscales, jueces, criminólogos) para saber el grado de credibilidad de una persona cuando responde a las preguntas sobre delito. El análisis de la comunicación no verbal ha estado relegado en un segundo plano hasta que en los años 60 algunos psicólogos empezaron a aplicarlo en la resolución de casos de abusos de menores; y en EE.UU. muchos profesionales han sido formados para detectar el engaño, tanto en acusados como en los testigos de un proceso judicial. El objetivo principal de esta tesis es saber si se puede aprender a detectar la mentira analizando la comunicación verbal y no verbal en un proceso judicial de los protagonistas del mismo (inculpado, parte acusadora, testigos, peritos, entre otros).Además, de plantearse la necesidad de que la formación que reciben los Cuerpos y Fuerzas de Seguridad, en concreto el Cuerpo Nacional de Policía en España, promoviendo que se amplié utilizando técnicas de comunicación para realizar los primeros interrogatorios, que son las más importantes en un proceso judicial y donde se pueden detectar más signos de engaño o no...
Oral and non-verbal communication are very important when analyzing trial testimony, as it helps us to carry out what experts call Criminal Profiling. Concept used both in the Security Forces and Bodies and in the judicial field (lawyers, prosecutors, judges, criminologists) to know the degree of credibility of a person when answering questions about crime.The analysis of non-verbal communication has been relegated to the background until in the 1960s some psychologists began to apply it to the resolution of cases of child abuse; and in the US many professionals have been trained to detect deception, both in defendants and witnesses in a judicial process.The main objective of this thesis is to know if it is possible to learn to detect lies by analyzing verbal and non-verbal communication in a judicial process of the protagonists of the same (defendant, accusing party, witnesses, experts, among others).In addition, considering the need for the training received by the Security Forces and Corps, specifically the National Police Corps in Spain, promoting its expansion using communication techniques to carry out the first interrogations, which are the most important in a judicial process and where more signs of deception can be detected or not...
