La suspensión del otorgamiento de las licencias urbanísticas

Abstract

Objetivos: 1.- Analizar si es necesario delimitar el derecho de propiedad y el ius aedificandi, y averiguar del material doctrinal, legislativo y jurisprudencial obtenido, si prevalece el interés general frente al particular o viceversa. 2.- Averiguar la postura del TEDH al hilo del objetivo expuesto en el punto 1, detallando la Jurisprudencia más relevante de dicho Tribunal. 3.- La búsqueda del origen de la figura de la suspensión del otorgamiento de las licencias urbanísticas en el Derecho comparado y si dicha figura en el Derecho comparado ha servido de antecedente a la figura de la suspensión del otorgamiento de las licencias urbanísticas regulada en el Derecho español. 4.- Confirmar del material doctrinal, legislativo y jurisprudencial obtenido, la naturaleza jurídica de la suspensión del otorgamiento de licencias, y si dicha naturaleza se configura como "medida cautelar". 5- Confirmar del material doctrinal, legislativo y jurisprudencial obtenido, si la figura de la suspensión del otorgamiento de las licencias urbanísticas en el Derecho autonómico sigue la influencia del derecho estatal supletorio, y analizar si se está produciendo o no un progresivo alejamiento del Derecho autonómico que regula la figura respecto del Derecho estatal supletorio...

Objectives: 1.- To analyse whether it is necessary to delimit property right and ius aedificandi, and ascertain, from the doctrinal, legislative and jurisprudential material obtained, whether the general interest prevails over private interest, or vice versa. 2.- To ascertain the stance taken by the European Court of Human Rights (ECHR) with regard to the objective expounded in point 1, detailing the aforementioned Court's most relevant jurisprudence. 3.- To search for the origin of the concept of the suspension of the granting of urban development licences in Comparative Law, and whether this figure in Comparative Law preceded the concept of the suspension of the granting of urban development licences regulated in Spanish Law. 4.- To confirm, from the doctrinal, legislative and jurisprudential material obtained, the legal nature of the suspension of the granting of licences, and whether this nature is configured as a "precautionary measure". 5- To confirm, from the doctrinal, legislative and jurisprudential material obtained, whether the concept of the suspension of the granting of urban development licences in Autonomous Community Law is influenced by the auxiliary state law, and to analyse whether or not the Autonomous Law that regulates the concept is moving progressively away from the auxiliary State Law...
