Los presos de ETA y el juego de la gallina.

Abstract

En este artículo se expone la experiencia de reinserción de presos terroristas en España. Los datos recogidos al respecto muestran que la política penitenciaria ha fracasado en este terreno, de manera que no ha servido para quebrar la fortaleza de las organizaciones terroristas dentro de las cárceles. El artículo muestra las razones de este fracaso utilizando para ello como instrumento analítico el Juego del Gallina. Este juego, propuesto por Bertrand Russell, permite establecer que, con pocas excepciones, los terroristas no querrán acogerse a la reinserción de manera individual y tratarán de hacerlo de forma colectiva, reforzando así su organización política. El maleficio del gallina impide así el éxito de la política penitenciaria. El autor propone que, para romper ese maleficio, se requiere una reforma legal que induzca a los terroristas a desvincularse de las organizaciones a las que pertenecen y que conceda a las víctimas una mayor participación en los procesos de reinserción.This article describes the experience of reintegration of terrorist prisoners in Spain. The data collected show about prison policy has failed in this area, so that has not helped to break the strength of terrorist organizations in the prisons. The article discusses the reasons for this failure using as an analytical tool the Game of Chicken. This game, proposed by Bertrand Russell, reflect that, with few exceptions, the terrorists will not want to benefit from the reintegration of individual and try to do this collectively, thereby strengthening its political organization. The curse of chicken and prevent the success of prison policy. The author proposes to avoid this problem, a legal reform that induce terrorists to disengage from the organizations they belong and to give victims greater participation in the process of reintegration.
