Abstract
La presente obra, que constituye la memoria para optar al grado de doctor presentada por Álvaro Javier San Martin Rodríguez, y titulada “Las drogas y el despido”, tiene como objetivos generales demostrar, de un lado, la ineficacia de la previsión contenida en el artículo 54.2 f) del Estatuto de los Trabajadores, por cuanto provoca más problemas que soluciones proporciona en cuanto al fenómeno del consumo de drogas en el ámbito laboral; de otro, en suministrar prueba fehaciente sobre lo acertado de las políticas públicas en su objetivo de construir una alternativa preventiva a la perspectiva actual, en lo fundamental reactiva, frente a esta problemática. Con el afán de alcanzar estos objetivos, la investigación aparece dividida en cuatro grandes partes: el primer capítulo analiza la evolución del consumo de alcohol, drogas y sustancias psicoactivas en España y su incidencia en el ámbito laboral, así como los factores que influyen en el consumo (entre los cuales se encuentra el trabajo), incluida la propia incidencia de este en la empresa y la persona, con el fin de defender la necesaria intervención empresarial del problema. El segundo capítulo analiza de forma sistematizada los diversos contextos normativos que abordan este problema en los ámbitos internacional, europeo, nacional y autonómico. En el tercer capítulo el autor realiza un profundo examen del art. 54.2 f) del Estatuto de los Trabajadores desde el punto de vista de su utilidad práctica, a la vista de los requisitos exigidos y del cuantioso número de fracasos a la hora de conseguir un despido no revocado en la búsqueda de la procedencia a través de esta vía. Finalmente, en el cuarto y último capítulo, tras el análisis de más de un millar de convenios colectivos, plantea la solución dada desde la negociación colectiva, donde las declaraciones de intenciones pasan a la planificación efectiva...
The present work, which constitutes the memory to qualify for the degree of doctor presented by Alvaro Javier San Martin Rodríguez, and entitled “The drugs and the dismissal”, has as general objectives to demonstrate, on the one hand, the ineffectiveness of the provision contained in the Article 54.2 f) of the Workers' Statute, as it causes more problems than solutions regarding the phenomenon of drug use in the workplace; on the other, in providing reliable proof of the correctness of public policies in their objective of building a preventive alternative to the current perspective, fundamentally reactive, in the face of this problem.In order to achieve these objectives, the research is divided into four parts: the first analyzes the evolution of the consumption of alcohol, drugs and psychoactive substances in Spain and its incidence in the workplace, as well as the factors that influence consumption ( among which is work) and its own incidence in the company and the person, to reason the necessary business intervention of the problem. The second chapter systematically analyzes the various normative contexts that address this problem from the international, European, national and regional point of view. In the third chapter the author performs a thorough examination of art. 54.2 f) of the Workers' Statute from the point of view of its practical utility, in view of the requirements demanded and the large number of failures in the search for provenance through this route. Finally, in the fourth and final chapter, after analyzing more than a thousand collective agreements, he raises the solution given from collective bargaining, where the declarations of intent go to effective planning...
