Migrações na Fronteira Sul da União Europeia: o Dever de Assistência dos Estados Europeus

Abstract

O Mediterrâneo converteu-se neste século XXI num espaço de exceção através da implementação de medidas dissuasórias às migrações irregulares, dentro do quadro normativo da União Europeia (UE). A gestão das migrações nesta fronteira meridional da Europa é um dos desafios mais significativos que a UE e os seus Estados-membros enfrentam na atualidade, onde a procura de um equilíbrio entre a garantia dos direitos humanos e a manutenção da segurança interna é essencial para assegurar a gestão destes fluxos migratórios. A questão que se impõe é sobre o dever de assistência aos migrantes, independentemente do seu estatuto, por parte dos Estados europeus, respeitando os acordos e normativas internacionais. Assim, é nosso propósito analisar os principais desafios à segurança humana colocados pela gestão das migrações na fronteira meridional da UE, para compreender as suas limitações ao nível da proteção dos indivíduos.In this 21st century, the Mediterranean has become a space of exception through the implementation of deterrence measures against irregular migration, within the normative framework of the European Union (EU). Managing migration on this southern border of Europe is one of the most significant challenges the EU and its Member States face today, where the search for a balance between guaranteeing human rights and maintaining internal security is critical to ensure the management of these migratory flows. The question that arises is regarding the duty of European states to assist migrants, regardless of their status, respecting international law and agreements. Thus, it is our purpose to analyze the main challenges to human security posed by the management of migration in the EU’s southern border, in order to understand its limitations in terms of the protection of individuals.
