La deontología profesional del abogado en la temprana Edad Moderna

Abstract

RESUMEN: La figura del abogado forma parte de la triada por excelencia de la literatura satírica, junto con el médico y el mercader. Quizá por ello resulta difícil encontrar un tratamiento ecuánime y desapasionado en los textos literarios, que oscilan entre la alabanza y el vituperio (con predominio de este último). El recurso a los manuales de confesores ayuda a paliar esa carencia: en el tribunal de la penitencia, el sacerdote no busca el enaltecimiento de la profesión (como los redactores de elogios de las profesiones en el ámbito humanista) ni su escarnio (como los autores satíricos), sino establecer los pecados del abogado. A través del estudio de esos pecados es posible reconstruir de forma más ecuánime las malas prácticas profesionales de los abogados en la Edad Moderna.ABSTRACT: The figure of the lawyer is part of the quintessential triad of satirical literature, along with the doctor and the merchant. Perhaps that is why it is difficult to find an unbiased and dispassionate treatment in literary texts, which oscillate between praise and vituperation (being the latter the predominant one). The use of confessors’ manuals will help to alleviate this lack: in the court of penance, the priest does not seek the praise of the profession (like the writers of acclaims of professions in the humanist sphere) nor its derision (like satirical authors), but to establish the sins of the lawyers. Through the study of these sins, it is possible to reconstruct in a more equitable way the bad professional practices of lawyers in the Modern Age.
