Contrato de Colaboración Público Privada

Abstract

Este trabajo pretende analizar los elementos clave de un grupo de figuras novedosas que se agrupan en la expresión colaboración público-privada. Se trata de una expresión que se refiere a diversas formas de colaboración entre los poderes públicos y los contratistas particulares cuya finalidad es la construcción, renovación y mantenimiento de una infraestructura o la provisión de un servicio público. El estudio contempla un análisis de los elementos característicos de los CPP, el estudio de la legislación española que va a regular esta figura y se analiza la modalidad más utilizada, el denominado arrendamiento operativo. Asimismo, contempla elementos de crítica a los CPP, que pasan por la utilización de la ingeniería jurídica, que conduce a cierta contabilidad de diseño y, por último, a la opacidad que suele haber en el procedimiento de adjudicación.The study aims to analyse the most important elements of the Public Private Partnership. The term refers to forms of cooperation between public authorities and the world of business which aim to ensure the funding, construction, renovation, management or maintenance of an infrastructure or the provision of a service. In the study you can find the characteristics elements of the PPP and systematically examine the problems that you can find, like the relationship with the budgetary stability. Also the study analyses the operational leasing, as a model of the PPP.
