Abstract
El derecho al olvido se ha convertido en los últimos años en un instrumento indispensable para asegurar la efectividad del derecho fundamental a la protección de datos personales extraído del artículo 18.4 CE. La exigencia de obtener la máxima funcionalidad de este derecho subjetivo por los particulares se encuentra estrechamente vinculada a necesidad de conocer cuál sea su alcance y, en última instancia, de cuales sean los requisitos para que pueda prosperar. La jurisprudencia europea y española se ha preocupado de sentar las bases y de señalar los parámetros exigidos para su ejercicio.
Se procede, con dicho propósito, a realizar un examen detallado de algunos de los casos más relevantes resueltos por los Tribunales de Justicia en los últimos años, vinculados con el nuevo derecho. Precisando su efectividad tanto en relación con la publicación de noticias por la prensa escrita, como respecto de su impacto en los buscadores de internet. Asimismo, se indaga en cuál es su operatividad cuando resulta afectado el derecho al honor, la intimidad personal y la propia imagen en colisión con la libertad de información; y también en el supuesto de protección de datos personales en colisión con el ejercicio del derecho a la libertad religiosa por las distintas confesiones.
The right to be forgotten has become in recent years an indispensable instrument to ensure the effectiveness of the fundamental right to the protection of personal data extracted from Article 18.4 SC. The requirement for individuals to obtain the maximum functionality of this subjective right is closely linked to the need to know what its scope is and, ultimately, what the requirements for it to succeed. European and Spanish jurisprudence has taken care to lay the foundations and to indicate the parameters required for its exercise. To this end, we proceed to carry out a detailed examination of some of the most relevant cases resolved by the Courts of Justice in recent years, related to the new law. Specifying its effectiveness both in relation to the publication of news by the written press, and its impact on Internet search engines. Likewise, it investigates what its operability is when the right to honor, personal privacy and one’s own image is affected in collision with freedom of information and also in cases of protection of personal data in collision with the exercise of the right to religious freedom by the different confessions.
