Abstract
La posibilidad de imponer la adopción de medidas de cesación a un proveedor de acceso que no presta acceso a Internet a quien infringe los derechos de autor sino a personas que pueden acceder a la oferta que viola tales derechos reviste particular importancia práctica. La solicitud de medidas cautelares para que proveedores de acceso a Internet bloqueen el acceso a sus usuarios a un sitio de Internet en el que se infringen derechos se ha convertido en una de las vías preferidas por los titulares de derechos para reaccionar frente a tales sitios, especialmente cuando éstos operan desde el extranjero. Al establecer el alcance y los posibles límites a tales medidas, resulta determinante la ponderación entre los derechos fundamentales implicados.
The possibility to order an Internet service provider the blocking of its customers’ access to a copyright-infringing website has become of particular practical significance. Rightholders request the adoption of such measures especially in situations where the infringing website is operated from a foreign country and hence the effectiveness of measures against the direct infringer may be uncertain. Striking a fair balance between the fundamental rights involved is essential to establish the scope and limitations of such injunctions against Internet access providers.
