La necesaria articulación y optimización de los niveles de protección del derecho a la salud de las personas mayores

Abstract

El presente artículo examina los aspectos más relevantes de la regulación del derecho a la salud de las personas mayores en tres niveles de protección: el sis- tema universal (Naciones Unidas), los sistemas regionales europeo, interamericano y africano, y el ordenamiento jurídico español. El análisis toma en consideración no solo los textos normativos que reconocen específicamente el derecho a la salud de las personas mayores, sino también aquellos que, a falta de una regulación diferenciada, prevén la protección del derecho a la salud de manera genérica. A la luz de este estudio, concluimos que es necesario aprobar tanto una convención universal como una ley integral estatal que proteja el derecho a la salud y los demás derechos de las personas mayores, y que estas regulaciones deberán tener en cuenta las disposiciones de los instrumentos regionales vigentes.

This paper examines the most relevant aspects of the regulation of the right to health for older people at three levels of protection: the universal system (United Nations), the European, Inter-American and African regional systems, and the Spanish legal system. The analysis considers not only the normative texts that specifically recognise the right to health for older persons, but also those that, in the absence of specific regulations, foresee the protection of health in a generic manner. In light of this study, we conclude that it’s necessary to adopt both a universal convention and a comprehensive national law to protect the right to health and the other rights of this age group, and that these regulations must take into account the provisions of current regional instruments
