dc.description.abstractLa presente investigación discute el origen y razón de ser del Estado moderno, su configuración contemporánea y la importancia de la existencia de garantías hacia las libertades y derechos de los ciudadanos. En este sentido, se destaca la importancia de la Constitución, verdadera creación de las revoluciones atlánticas (Blanco Valdés, 2010) y de la doctrina de la división y separación de los poderes del Estado. Y ello, porque bajo el post-revolucionario Estado Constitucional, se produjo una notable concentración del poder político, hecho característico y diferencial ante la difuminación y dispersión del precedente Antiguo Régimen. Diversos autores como Locke, Montesquieu o Madison, advirtieron de la necesidad de crear mecanismos de control y división del poder político ante el nuevo modelo de Estado que todos ellos, aun desde diferentes ópticas, proponían. De este modo, la división y separación de los poderes del Estado se convirtió en un mínimo común de entre los principales teóricos políticos de la Ilustración, considerándola como una garantía ante hipotéticas tiranías. Asimismo, el nacimiento de los Estados Constitucionales a ambos lados del Atlántico trajo consigo una diferenciación en cuanto a la forma de gobierno: el presidencialismo y el parlamentarismo. El primero, como sistema genuinamente americano; y el segundo, predominante en Europa desde las experiencias de Reino Unido y los modelos continentales que nacieron tras la Revolución Francesa. Sin embargo, esta distinción no fue irrelevante, ya que la legitimidad sobre la que descansara el Jefe del Estado determinó en buena medida la relación entre los poderes, especialmente, entre el Ejecutivo y el Legislativo...
dc.description.abstractThe present research discusses the origin and raison d' etre of the modern State, its contemporary configuration and the importance of the existence of guarantees towards the freedoms and rights of citizens. In this sense, the importance of the Constitution, a truly creation of the Atlantic revolutions (Blanco Valdés, 2010) and the doctrine of the division and separation of the powers, is remarkable. And this, because under the post-revolutionary Constitutional State, there was a noteworthy concentration of political power, characteristic and differential fact before the blurring and dispersion of the previous Ancient Regime. In this sense, several authors like Locke, Montesquieu or Madison, warned of the necessity of creating mechanisms of control and division of the political power before the new model of State that all, even from different optics, proposed. In this way, the division and separation of state powers became a common minimum among the leading political theorists of the Enlightenment, considering it as a guarantee against hypothetical tyrannies. Likewise, the birth of the Constitutional States on both sides of the Atlantic, brought with it a differentiation in the form of government: presidentialism and parliamentarism. The first, as a genuinely American system; and the second, predominant in Europe from the experiences of the United Kingdom and the continental models that were born after the French Revolution. However, this distinction was not irrelevant, since the legitimacy on which the Head of State rested determined to a large extent the relationship between the powers, especially between the Executive and the Legislature...
