Abstract

Cuando se redactó la Constitución de 1978 se hizo sentir la necesidad de un precepto específico que habilitase al Estado para consentir la atribución del ejercicio de competencias soberanas a fin de poder aspirar a ingresar en las, entonces, Comunidades Europeas al tiempo que protegiese los efectos propios del Derecho de la Unión Europea en España. También trataba de articular las relaciones entre la soberanía nacional y el derecho interno con las atribuciones del ejercicio de competencias constitucionales en favor de la UE junto con la aceptación de la aplicación obligatoria, inmediata y preferente del ordenamiento de la Unión (acervo). Esa cláusula (art. 93 CE) es muy insuficiente y se propone reformas de ese precepto constitucional.
