La alta traición en época de Tiberio según los anales de Tácito

Abstract

Este trabajo tiene como objetivo el análisis de la aplicación del delito de alta traición en la época de Tiberio, de acuerdo fundamentalmente con la narración realizada por el historiador Tácito. Además, se pretende estudiar las relaciones entre el emperador y el Senado y, sobre todo, los motivos por los que Tiberio decidió que la Cámara fuera el principal órgano judicial respecto a los delitos cometidos por los senadores y en especial en los procedimientos de alta traición. Además, se debe diferenciar si el delito enjuiciado era el delito de traición por la realización de vejaciones o insultos hacia Tiberio o si se estaba aplicando la modalidad más grave del delito de lesa majestad, esto es, el delito de perduellio. Finalmente, se van a analizar los efectos procesales del delito, si el proceso continuaba tras la muerte del reo por suicidio, en los delitos de perduellio, y si se podía emplear el testimonio de los esclavos como medio de prueba...

The purpose of this work is investigating the high treason crime evolution under the government of Tiberius and the legal processes associated with the Maiestas roman law. The main innovation of this emperor was allowing the Senate, as the High Court, to judge Senators committed crimes, which affected both the development of the crime and the relationship between Tiberius and the Senate.It also has to be decided if when describing the trials, Tacitus defines the crime of high treason as acts of abuse or verbal attacks against the Caesar or whether it was the defendant, the one responsible of a conspiracy against either the state or the emperor.Finally, it is important to note the legal consequences of the crime, the use of the slave’s testimony as legal evidence against their owners and the effects of the defendant’s suicide over an open trial, and if this defendant’s death concluded the legal process without a sentence...
