Abstract
Este artículo analiza el modo en que se ha reconocido y materializado en España el derecho a la justicia de las víctimas de graves violaciones a los derechos humanos y/o crímenes internacionales cometidos durante la Guerra Civil y la dictadura franquista. Para ello, se tomará como punto de referencia temporal clave la aprobación de la Ley de Memoria Democrática. Examinando, en consecuencia, la situación anterior y sobre todo posterior a ese momento, y confrontado lo acontecido con el régimen jurídico internacional aplicable a estos supuestos.
This article examines how the Right to Justice has been recognized and implemented in Spain for victims of serious human rights violations and/or international crimes committed during the Spanish Civil War and the Francoist dictatorship. It takes the enactment of the Law of Democratic Memory as a key temporal reference point, examining the legal and institutional context before —and especially after— its adoption and enter into force. The Spanish case is then evaluated in light of the applicable international legal framework governing such cases.
