Dictamen jurídico. Delito de trata de seres humanos del art. 177 bis CP

Abstract

El presente dictamen analiza un caso real, y bastante frecuente en la práctica, de trata de seres humanos con fines de explotación sexual cometido en España contra víctimas nigerianas. Parte de la calificación jurídica de los hechos y se centra en el estudio de los tipos actuales del delito de trata de seres humanos, del delito de prostitución coactiva y del de inmigración clandestina, pero no teóricamente, sino para el encaje de los hechos, con una orientación práctica al caso. También analiza las relaciones concursales existentes entre todos los delitos concurrentes, la jurisdicción y los órganos competentes, la validez y eficacia de las declaraciones testificales de las víctimas y los derechos y medios de protección de que disponen las víctimas de trata de seres humanos.

This opinion analyzes a real case, quite frequent in practice, of human trafficking for the purpose of sexual exploitation committed in Spain against Nigerian victims. It starts from the legal qualification of the facts and focuses on the study of the current types of the human trafficking crime, the prostitution crime and the illegal immigration crime, but not theoretically, but for the fit of the facts, with a practical orientation to the case. It also analyzes the concurrent crimes, the jurisdiction and the competent court, the validity and effectiveness of the witness statements of the victims, and the rights and means of protection available to victims of trafficking in human beings.
