Abstract
La motivación de esta tesis surge de la observación de familias inmersas en un escenario de alta conflictividad ante situaciones de separación o divorcio, en las que parece que dichos conflictos toman una trascendencia especial cuando los mecanismos jurídicos entran en funcionamiento, produciéndose un salto de nivel en el conflicto. Así, se desencadenan procesos legales que pretenden resolver la problemática familiar, lo cual implica que se lleven a cabo una serie de acciones dirigidas al mismo fin (acusaciones, defensas, alianzas, etc.). Sin embargo, lo que suponen muy frecuentemente, es un aumento del conflicto.Así, estas familias están en riesgo de sufrir unas duras consecuencias psicológicas y emocionales, como trastornos de ansiedad o depresión (Amato, 2010; Gómez-Ortiz et al., 2017; Kelly y Emery, 2003; Muñoz-Ortega et al., 2008); violencia, adicciones, o problemas de conducta (Fariña et al., 2020). Pero quienes suelen sufrir especialmente estas consecuencias, son los descendientes de estas parejas.Por lo tanto, proponemos estudiar este fenómeno, denominado judicialización, como una dinámica más, muy frecuente en casos de separación o divorcio altamente conflictivo...
The motivation for writing this paper arises from the observation of families immersed in high conflict situations when going through separation or divorce. It appears that, when legal mechanisms are applied, these conflicts become highly significant as they trigger accusations, explanations, and other actions whose purpose is to solve the issue, but rather make the judicial instances become part of the problem by regulating the parent-child relationship according to law. However, this implies the family needs these judicial instances to function properly, depending on the legal system to solve their conflicts.Therefore, these kinds of families are at risk while suffering the hard consequences of relating this way. Most of them suffer anxiety or depression disorders (Amato, 2010; Gómez-Ortiz et al., 2017; Kelly y Emery, 2003; Muñoz-Ortega et al., 2008), as well as violence, addictions, or behavioral issues (Fariña et al., 2020). The ones who suffer the most, are the children.As result, it is proposed the study of this phenomenon, called judicialization, as an additional dynamic that is frequently present in high conflict separations cases...
