Abstract
El presente artículo analiza la realidad del sector mundial de cruceros en relación con los conceptos de puerto y de tráfico marítimo que acoge la ley de puertos. Describe la evolución del tráfico de cruceros en Norteamérica y Europa. Su incidencia en los puertos españoles y su influencia en el crecimiento del sector turístico español. Comienza con un examen del cuál es el concepto jurídico de puerto y el tráfico marítimo que se maneja en la Ley de
puertos de 1992 y en el Real Decreto Legislativo 2/2011, de 5 de septiembre, por el que se aprueba su texto refundido. Asimismo, estudia la noción de tráfico portuario o de tráfico marítimo en los puertos.
En un segundo bloque, se examina el tráfico de cruceros marítimos de pasajeros. Cómo ha sido el transporte marítimo de pasajeros a lo largo de la historia. Cuáles son las nuevas modalidades de transporte de viajeros del
último tercio del siglo XX y en la actualidad. El crecimiento continuado del tráfico de barcos-cruceros como modalidad turística desde finales de la década de los ochenta en Europa.
Los apartados tercero y cuarto profundizan, respectivamente, en la realidad del tráfico de los cruceros marítimos en el conjunto de los puertos españoles. y en el cuál es su impacto en la economía española. Para terminar con unas conclusiones que tratan de fijar la consideración jurídica y la relevancia económica y social que han adquirido en el momento presente.
Abstract: This article analyzes the reality of the global cruise industry in relation to the concepts of port and maritime traffic included in the port law. It describes the evolution of cruise traffic in North America and Europe. Its impact on Spanish ports and its influence on the growth of the Spanish tourism sector. It begins with an examination of what is the legal concept of port and maritime traffic that is handled in the Law of ports of 1992 and in Royal Legislative Decree 2/2011, of 5 September, approving its revised text. It also studies the notion of port traffic or maritime traffic in ports. In a second block, the traffic of maritime passenger cruises is examined. What maritime passenger transport has been like throughout history. What are the new modes of passenger transport in the the last third of the twentieth century and today. The continued growth of cruise ship traffic as a tourist modality since the end of the eighties in Europe. The third and fourth paragraphs delve, respectively, into the reality of maritime cruise traffic in all Spanish ports. and on what is its impact on the Spanish economy. To conclude with some conclusions that try to establish the legal consideration and the economic and social relevance that they have acquired at the present time.
