Abstract
Han pasado casi diez años desde que la pena de prisión permanente revisable fue introducida en el ordenamiento jurídico español, generando un extenso debate sobre su constitucionalidad. Esta pena, destinada a los delitos más graves, ha sido validada por el Tribunal Constitucional en la STC 169/2021, aunque sigue siendo objeto de crítica. Los principales cuestionamientos giran en torno a su posible inhumanidad, la proporcionalidad de su duración y su compatibilidad con el mandato de reinserción social, lo que plantea importantes reflexiones sobre su impacto en la política penal y constituye, precisamente, el objeto del presente trabajo.
It has been nearly ten years since the Permanent reviewable imprisonment sentence was introduced into the Spanish legal system, generating an extensive debate about its constitutionality. This sentence, intended for the most serious crimes, has been upheld by the Constitutional Court in STC 169/2021, although it remains subject to criticism. The main concerns revolve around its potential inhumanity, the proportionality of its duration, and its compatibility with the mandate of social reintegration, concerns that raise important reflections on its impact on penal policy and constitute, precisely, the object of this work.
