La responsabilidad civil en la propiedad intelectual

Abstract

Esta tesis doctoral tiene su punto de partida en un problema global de la sociedad actual y que se acentúa especialmente en nuestro país: la gran cantidad de ilícitos contra la propiedad intelectual que se producen, tanto mediante las nuevas tecnologías e internet, como en los tradicionales soportes en formato físico. Tomando como premisa dicho problema, la tesis aporta soluciones mediante el análisis de una de las tres vías que todo gobierno ha de promover en el campo de la protección de la propiedad intelectual, como es la mejora del sistema legislativo. Las otras dos vías de acción, complementarias a la actividad legislativa, se basan en la concienciación social del impacto negativo que tiene la piratería para la economía de nuestro país, y la oferta privada de nuevas plataformas de pago a precios asequibles que permitan al usuario tener una gran cantidad de contenido legal sin salir de su zona de confort, para que de esa forma, no sienta la necesidad de acudir al contenido ilegal...This doctoral thesis has its starting point in a global problem of today's society and is accentuated especially in our country: the large number of illicit acts against intellectual property that eventually takes part, both through new technologies and the Internet, as in traditional supports in physical format. Taking this issue as a premise, this thesis provides solutions by analyzing one of the three pathways that every government has to promote in the field of intellectual property protection, such as the improvement of the legislative system. The other two courses of action, complementary to the legislative activity, are based on social awareness of the negative impact that piracy has on the economy of our country, and the private offer of new payment platforms at affordable prices that allow the users to have a lot of legal content without leaving their comfort zone, so that, in this way, they do not feel the need to resort to illegal content...
