Abstract
Las nuevas guerras asociadas al tercer nivel, esto es, a los Estados débiles inmersos en conflictos armados, constituyen un singular caldo de cultivo para los tratantes de seres humanos, verbigracia terroristas y criminales, cuyo objetivo más simple son los menores. La necesidad de conjugar la lucha contra la impunidad de los autores de este abominable mercantilismo humano y la necesidad de proteger a las víctimas en los entornos de emergencia repentina (singularmente niños y niñas) justifican el examen de la trata de la infancia desde un enfoque basado en los derechos humanos. En particular, a la luz de la obligación estatal de prevención -cuya génesis se enraíza en la diligencia debida que se requiere de un Estado en su territorio- y de la hipótesis inacabada de la responsabilidad de proteger en el marco de los crímenes más graves de trascendencia para la comunidad internacional a los que pueden dar lugar ciertas violaciones de derechos humanos cometidas en el entorno de la trata.
The new wars associated with the third level, that is, with weak States immersed in armed conflicts, constitute a unique breeding ground for human traffickers, terrorist and criminals verbigracy, whose simplest objective are minors. The need to combine the fight against impunity of the perpetrators of this abominable human mercantilism and the need to protect victims (particularly children) in suddenonset emergency environments justifies considering trafficking in persons from a human rights-based approach, especially within the framework of the State obligation of prevention, the genesis which is rooted in the due diligence required of a State in its territory, as well as the unfinished responsibility to protect in the context of atrocity crimes that may result in certain violations of human rights committed in the context of trafficking.
