Reflexiones sobre la respuesta estatal a mujeres denunciantes de violencia de género: necesidades y resultados en el marco del proceso penal

Abstract

El presente trabajo consiste en una investigación sobre la respuesta punitiva estatal a las mujeres víctimas de violencia masculina en la Ciudad Autónoma de Buenos Aires (Argentina). Con ese fin y con una perspectiva interseccional, los objetivos consisten en indagar sobre aquello que persiguen las mujeres al recurrir a la Justicia Penal, identificar los problemas que surgen y el impacto en sus vidas del proceso, e identificar la posible necesidad de otras estrategias. Lo anterior se plantea con el fin de contribuir al análisis de la respuesta penal tal como se brinda hoy en día en un contexto específico. En la actualidad, la necesidad de la intervención del Estado desde la perspectiva del castigo en la violencia masculina contra las mujeres se encuentra siendo ampliamente debatida dentro de los feminismos. En ese sentido, este trabajo se propone identificar las teorías imperantes al respecto y definir los objetivos de la Justicia Penal, a fin de arribar a una conclusión sobre su utilidad y conveniencia, luego de contrastado con la información relevada en la investigación. Para cumplir con los objetivos, se realizaron siete entrevistas a personas que se desempeñan laboralmente en oficinas de prestación de Justicia Penal en la Ciudad Autónoma de Buenos Aires, tanto hombres como mujeres, de diferentes zonas geográficas y grados de especificidad en la materia. La decisión de no entrevistar a mujeres víctimas de violencias masculina se basó en evitar la revictimización que implicaría repetir un relato y, a su vez, obtener la mayor cantidad de información posible.

This research consists in an investigation on the state punitive response to women victims of male violence in the Ciudad Autónoma de Buenos Aires (Argentina). To this end and with an intersectional perspective, the aims is to investigate what women are pursuing when resorting to Criminal Justice, identifying the problems that arise and the impact of the process on their lives, as well as identifying the possible need for other strategies. The foregoing is proposed in order to contribute to the analysis of the criminal response as it is provided today in a specific context. At present, the need for State intervention from the perspective of punishment in male violence against women is being widely debated within feminisms. In that sense, this work aims to identify the prevailing theories in this regard and define the objectives of Criminal Justice, in order to reach a conclusion about its usefulness and convenience, after being contrasted with the information gathered in the investigation. In order to achieve the aims, seven interviews were conducted with people who work in criminal justice offices in the Ciudad Autónoma de Buenos Aires, both men and women, from different geographical areas and degrees of specificity in the matter. The decision not to interview female victims of male violence was based on avoiding re-victimization, which would imply repeating a story and, also, obtaining as much information as possible.
