Paradores de Turismo: un examen jurídico crítico del elefante en la habitación

Abstract

En el presente artículo se somete a un examen crítico a la empresa pública estatal Paradores de Turismo. Se analizan las competencias del Estado para mantener la gestión de estos establecimientos de alojamiento y restauración y se estudia la necesidad de mantener la prestación de estos servicios turísticos directamente por el sector público, cuando no se tratan de servicios públicos ni de interés general. Por otro lado, se valora si la gestión debe mantenerse en manos del Estado o, por el contrario, trasladarse a las comunidades autónomas, quienes tienen la competencia exclusiva en materia de turismo.This article critically examines the state-owned public company Paradores de Turismo. It analyses the State's powers to maintain the management of these accommodation and catering establishments and studies the need to maintain the provision of these tourist services directly by the public sector, when they are not public services or services of general interest. On the other hand, it assesses whether management should remain in the hands of the State or, on the contrary, be transferred to the Autonomous Communities, which have exclusive competence in the field of tourism.
