Economía del bienestar y corrupción en el marco de la teoría de la justicia

Abstract

El fenómeno de la corrupción no es algo nuevo, pues ha existido en todo tiempo y lugar. Sin embargo sorprende que en los inicios del siglo XXI, en una sociedad avanzada, que se ha ido desarrollando a lo largo de los últimos siglos y que presume de un estado de bienestar y de grandes logros en diversos ámbitos, nos encontremos con esta plaga que de ninguna manera podemos justificar ni ser tolerantes. Este fenómeno continúa imparable a pesar de los grandes esfuerzos realizados por los distintos poderes, tanto a nivel normativo, como institucional. En la actualidad, los niveles de corrupción, no solamente no desaparecen sino que se extienden y acentúan llegando a ser uno de los problemas que más preocupan a la sociedad española, como se desprende de las últimas encuestas del Centro de Investigaciones Sociológicas (CIS). La búsqueda del impacto de la corrupción en el Estado del Bienestar, tomando como referencia la variable de la distribución de la renta y algunos indicadores muy ilustrativos, como el Índice de Gini, constituye el objeto de esta Tesis Doctoral que, desde una perspectiva jurídico-económica nos va a permitir conocer la incidencia de la corrupción en la Economía del Bienestar. Asimismo, se ha superado, con esta Tesis, la fragmentación doctrinal y teórica, enmarcando el binomio bienestar-corrupción en el área amplia, original y rigurosa de la Teoría de la Justicia, mediante el análisis de sus diferentes ramas, muy especialmente del contractualismo y del utilitarismo...

As social phenomena, corruption is nothing new; it has existed throughout ages and places. Nevertheless, at the turn of the 21st century it is surprising to find and tolerate such an unjustified plague in an advanced society that has developed over the last few centuries, one that boasts of a well-consolidated welfare state and enjoys great technological and social achievements. This phenomena seems to be unstoppable despite the tremendous efforts made by the various normative and institutional powers. At present, corruption levels are not only not disappearing, but are becoming worse and keep spreading, and have turned into one of the most worrying matters for Spanish society, as can be seen in the latest surveys of the Center for Sociological Investigations (CIS, in Spanish). The search for the impact of corruption in the welfare state, taking as reference the variable of the distribution of income and other enlightening indicators, such as Gini's Quotient, makes up the subject of this doctoral thesis which will allow us to know the incidence of corruption in the welfare state economy from a legal-economic perspective. As such, with this thesis, the doctrinal and theoretical fragmentation has been overcome, as well as framing the welfare-corruption binomial within the wide, original and rigorous Theory of Justice, by means of the analysis of its various branches, and in particular that of contractualism and utilitarianism...
