La figura de la reelección presidencial indefinida, en el contexto del Sistema Interamericano de Derechos Humanos

Abstract

Este capítulo, presentado como opinión escrita ante la Corte Interamericana de Derechos Humanos en el marco de la solicitud de opinión consultiva promovida por Colombia, examina la reelección presidencial indefinida desde el derecho internacional de los derechos humanos y el constitucionalismo democrático interamericano. A partir del vínculo entre libre determinación y democracia (Carta Democrática Interamericana y Carta de la OEA), los autores sostienen que la reelección indefinida no se configura como un derecho humano y que su normalización puede erosionar el pluralismo, la igualdad en la competencia política y la alternancia en el poder. Mediante una interpretación del artículo 23 de la Convención Americana, el texto argumenta que las garantías de participación y de acceso a funciones públicas en condiciones de igualdad se ven estructuralmente afectadas cuando se habilita la perpetuación en el cargo, especialmente por las ventajas del incumbente y la concentración progresiva del poder.

This book chapter—submitted as a written opinion to the Inter-American Court of Human Rights in connection with Colombia’s request for an advisory opinion—assesses indefinite presidential re-election through the lens of international human rights law and Inter-American democratic standards. Building on the relationship between self-determination and democracy as articulated in the Inter-American Democratic Charter and the OAS Charter, the authors contend that indefinite re-election is not a human right and that its adoption may undermine pluralism, equal political competition, and the principle of alternation in power. Through an interpretive reading of Article 23 of the American Convention on Human Rights, the chapter argues that the rights to political participation and equal access to public office are structurally distorted when incumbency can be renewed without limits, particularly given the cumulative advantages of office and the risks of power entrenchment.
