Abstract
Esta investigación pretende la comprensión de la figura procesal del testigo-perito. Su consagración por primera vez en la LEC, no acompañada, sin embargo, de un tratamiento legal propio, unido a su carácter controvertido en la práctica forense y al hecho de que en España no haya sido tratada in extenso, nos parecieron motivos suficientes para justificar un estudio que aspira a encontrar su razón de ser, aclarar su naturaleza y proponer algunas pautas para, al menos, atenuar su problematicidad. Para alcanzar estos objetivos, se propone primero una aproximación desde la teoría del conocimiento que además de necesaria por lo que a continuación se señala, permite un abordaje de la figura desde sistemas de tradición no civilista y de este modo subrayar algunas analogías que están en las bases de la definición de testigo, procesalmente hablando, pero también del diseño de la prueba testifical y de su testimonio ideal...
This study aims to analyze the procedural figure of the “testigo-perito”. Though recognized for the first time in the Spanish Civil Procedure Act (LEC), this figure remains without a dedicated legal framework. This omission, combined with its controversial nature in forensic practice and the fact that it has not been extensively analyzed in Spain, seemed to us sufficient reasons to justify a study that aims to uncover its underlying rationale, clarify its juridical nature, and propose some guidelines that may attenuate the complexities surrounding its use. To achieve these objectives, the study begins by adopting an epistemological perspective. This approach, in addition to being necessary for the reasons outlined below, allows for an examination of the figure from non-civil law traditions. This comparative perspective highlights analogies that underpin the procedural definition of the witness, as well as informing the rules governing testimonial evidence and the theoretical construct of an ideal testimony...
