Abstract
Se analiza la reciente sentencia Gjensidige del Tribunal de Justicia, acerca de los límites del control de la competencia del tribunal de origen y de la incompatibilidad con el orden público como fundamento de la denegación del reconocimiento de una resolución de otro Estado miembro. Asimismo, se aborda la contraposición de los regímenes en materia de eficacia de los acuerdos de jurisdicción entre el artículo 25 RBIbis y el artículo 31 CMR y sus implicaciones en materia de determinación de la competencia judicial internacional y de reconocimiento y ejecución de resoluciones.
The recent Gjensidige judgment of the Court of Justice is discussed. Its significance to clarify the limited reach of the review of the jurisdiction of the court of origin and the incompatibility with public policy as grounds for refusing recognition of a judgment of another Member State under the Regulation is analysed. The implications of the differences between Article 25 Brussels Ia Regulation and Article 31 CMR as to effectiveness of jurisdiction agreements are also discussed regarding the determination of international jurisdiction and the recognition and enforcement of judgments between EU Member States.
