Los sujetos protegidos por la asistencia sanitaria pública española y el derecho de los españoles a la asistencia sanitaria pública en el extranjero

Abstract

La tesis presente lleva por título Los sujetos protegidos por la asistencia sanitaria pública española y el derecho de los españoles a la asistencia sanitaria pública en el extranjero y surge de la ausencia de estudios enfocados en el aspecto subjetivo del derecho. Aunque se trate de un derecho objeto de debate público y social, no existe un interés en la doctrina en conocer y analizar con profundidad la relación de la asistencia sanitaria con los sujetos que la disfrutan. Entender los mecanismos de reconocimiento del derecho nos permite comprender mejor las reformas normativas promovidas por el legislador y la evolución de este derecho. Para ello, se recopilan las normas más relevantes en el desarrollo de la asistencia sanitaria en España y en el derecho internacional, dando especial relevancia a la normativa comunitaria, debido a su gran influencia en nuestro derecho interno. También se procede al análisis del impacto del reconocimiento del derecho a la asistencia sanitaria en la legislación de extranjería tras la reforma promovida por el Real Decreto-ley 16/2012, de 20 de abril...The present Thesis is titled Subjects protected by Spanish public healthcare and the right of Spaniards to public healthcare abroad and arises from the lack of studies focused on the people with access to the public healthcare. Although it is a right that is the discussion centre of public and social opinion, there is no interest in the doctrine in studying and analysing the relationship between health care and the people that have access to it. Understanding the mechanisms of recognition of the right allows us to better understand the regulatory reforms promoted by the legislator and the evolution of this right.To this end, this Thesis bring together the most relevant regulations in the development of healthcare in Spain and in international law, with special relevance to EU regulations, due to their great influence on our domestic law.
