Mediación en familias migrantes en atención a la diversidad cultural en el Chile de hoy

Abstract

Este trabajo describe las particularidades que pueden desarrollar las estrategias contempladas en una política pública de resolución de conflictos para familias migrantes cuando se utiliza la mediación para conseguir el respeto a la diversidad en el marco legal como es el caso de Chile para dar respuesta a la sociedad compleja del siglo XXI. Para ello, describe la situación actual de las familias migrantes con las problemáticas que enfrentan en la gestión de sus conflictos en el sistema de justicia chileno, avanzando en la generación de algunos lineamientos implementados en el sistema privado, que pueden constituirse en facilitadores para el acceso a justicia.

This paper describes the peculiarities that can develop the strategies envisaged in a public policy of resolution of conflicts for migrant families when the mediation is used to obtain the respect to the diversity in the legal framework as it is the case of Chile to respond to the complex society of the 21st century. To this end, it describes the current situation of migrant families with the problems they face in the management of their conflicts in the Chilean justice system, advancing in the generation of some guidelines implemented in the private system, which can to become facilitators for access to justice.
