Insolvencia de la persona física. Prevención y solución

Abstract

La insolvencia de la persona física requiere un abordaje jurídico global. La regulación del préstamo responsable, el tratamiento del régimen de segunda oportunidad, las reformas en materia de ejecución hipotecaria son aspectos tratados en el presente trabajo. Así mismo, se analiza el impacto de las medidas en el acceso al mercado crediticio, particularmente, la regulación de los ficheros de solvencia patrimonial.

The insolvency of natural person requires a global approach. The regulation of responsible lending, the treatment of the "second chance" in bankruptcy code, and the mortgage foreclosure of main residence are issues studied in this paper. Furthermore, we analyze the impact of this regulation in the credit market, specially, paying attention in spanish credit reporting system.
