Abstract
En el contexto del “Asunto relativo a la inmovilización de tres buques de guerra ucranianos (Ucrania c. Federación de Rusia), Medidas Provisionales”, este trabajo analiza las medidas provisionales, en su condición de procedimiento incidental, y, en particular, los principales caminos que debe transitar el Tribunal Internacional de Derecho del Mar (TIDM) en el marco del párrafo 5 del artículo 290 de la Convención. Se trata, en concreto, de examinar las declaraciones estatales formuladas a la luz del artículo 287 de la Convención; la competencia prima facie del Tribunal arbitral previsto en el Anexo VII de la Convención, incluidos sus entresijos como, por ejemplo, la posición de Ucrania y de la Federación de Rusia con respecto a la Convención y a otras normas jurídicas presuntamente aplicables al caso; las condiciones legales que subyacen a la prescripción de las medidas provisionales; y finalmente, el cumplimiento de tales medidas.
In the context of the "Matter concerning the immobilization of three Ukrainian warships (Ukraine v. Russian Federation), Provisional Measures", this paper analyzes the provisional measures, as an incidental procedure, and, in particular, the main ways that the International Tribunal for the Law of the Sea (TIDM) must travel within the framework of paragraph 5 of article 290 of the Convention. In particular, it is about examining state declarations formulated in light of article 287 of the Convention; the prima facie jurisdiction of the Arbitral Tribunal set forth in Annex VII of the Convention, including its intricacies such as, for example, the position of Ukraine and the Russian Federation with respect to the Convention and other legal norms presumably applicable to the case; the legal conditions that underlie the prescription of provisional measures; and finally, the fulfillment of such measures.
