La doctrina de los conceptos autónomos en el sistema del convenio europeo de derechos humanos: jurisprudencia reciente

Abstract

El sistema del Convenio Europeo de Derechos Humanos constituye un estándar mínimo de protección. Ofrece un margen de apreciación a los Estados, los cuales pueden atender mejor a las realidades jurídicas, económicas y sociales concretas y específicas en las que se debe implementar el sistema de garantía y protección del CEDH. Empero, el TEDH cumplirá una importante labor de supervisión del respeto nacional a los derechos reconocidos en el Convenio. Por ello, elabora conceptos autónomos con los que se pretende garantizar y proteger el contenido de los derechos y libertades de clasificaciones e interpretaciones nacionales que puedan soslayar su sentido y finalidad. En este trabajo se ofrecen ejemplos recientes de la jurisprudencia en los que se perfila la doctrina de los conceptos autónomos como técnica protección efectiva del estándar mínimo de los derechos humanos frente a pretensiones estatales de huida en la aplicación del régimen de garantías procesales y sustantivas.

The European Convention on Human Rights system implies a minimum standard of protection. It provides a margin of appreciation to the States that can better address the specific legal, economic and social realities in which the ECHR system of guarantee and protection must be implemented. However, the ECHR will play an important role in monitoring national respect for the rights recognized in the Convention. For this reason, it develops autonomous concepts with which it is intended to guarantee and protect the content of the rights and freedoms of national classifications and interpretations that can circumvent its meaning and purpose. This paper offers recent examples of case-law in which the doctrine of autonomous concepts is outlined as a technical effective protection of the minimum standard of human rights against State claims of flight in the application of the procedural and substantive guarantees regime.
