Abstract
El presente trabajo de investigación estudia y propone estándares para establecer una Autoridad de Control en materia de protección de datos para Chile, tomando como referencia la experiencia comparada, principalmente europea y especialmente española. Se analiza el desarrollo de la protección de datos personales como derecho fundamental, sustancialmente en la Europa continental, abordando la relación de este derecho con otros derechos fundamentales, como el derecho a la intimidad y el respeto y protección a la vida privada. Producto del vertiginoso desarrollo de las tecnologías de la información, la inteligencia artificial, el masivo almacenamiento de datos y su tratamiento en los sectores públicos y privados, así como su transferencia a otros países, existe una situación en la que las personas pueden quedar a merced de quienes manejan la información que les concierne. Para protegerlas se ha configurado, primordialmente en Europa, un derecho fundamental que tiene una independencia y autonomía propias, lo que nos lleva a analizar la normativa europea. Entre las normas europeas más importantes encontramos el Convenio 108 del Consejo de Europa (28/01/1981); la Directiva 95/46/CE del Parlamento Europeo y del Consejo, de 24 de octubre y; el Reglamento General de Protección de Datos 2016/679 de 27 de abril. This research of this thesis studies and proposes standards to establish a Control Agency for data protection in Chile, taking as a reference the comparative experience of principally Europe and especially Spain. The analyses of data protection development as a fundamental right substantially in continental Europe, together with addressing the relationship of this right with other fundamental rights, such as the right to privacy, and the respect/protection of private life.As a result of the vertiginous development of information technologies, artificial intelligence, the massive storage of data and its treatment in the public and private sectors, as well as its transfer to other countries, there is a situation in which people can be left at the mercy of those who handle the information that concerns them. To protect them, a fundamental right has been configured, primarily in Europe, that has its own independence and autonomy, which leads us to analyze European regulations. Among the most important European standards we find Convention 108 of the Council of Europe (01/28/1981); Directive 95/46/CE of the European Parliament and of the Council, of October 24 and; the General Data Protection Regulation 2016/679 of April 27. This European legal framework will be completed with the future regulations of the European Union: the European Regulation on Digital Services and the Regulation on Digital Markets...
