Perspectivas contemporáneas sobre Derechos Humanos desde la Antropología Social

Abstract

Los Derechos Humanos se han convertido en un instrumento legitimado y reconocido casi universalmente, se han extendido por todas las latitudes y se ha vuelto un lenguaje ordinario entre distintos sectores poblacionales, independientemente de su procedencia. Al enfrentarse a los Derechos Humanos los antropólogos y las antropólogas han vislumbrado la importancia de deslizar la atención desde el régimen jurídico global, hacia el estudio de los propios modos de operar de las instituciones jurídicoadministrativas, así como hacia las formas de apropiación por los agentes sociales. En este artículo abordamos las causas del éxito del lenguaje de los derechos humanos, analizamos las limitaciones de un enfoque meramente juridicista y la obligada reorientación de la temática hacia “la vida social de los derechos”. En consonancia con lo expuesto, proponemos finalmente líneas de investigación que resaltan las aportaciones de la etnografía al tema.

Human Rights have become a legitimate and almost universally recognized instrument, they have spread throughout all latitudes and have become an ordinary language among different population sectors, regardless of their origins. Dealing with Human Rights, anthropologists have glimpsed the importance of shifting attention from the global legal regime, towards the study of the modes of operation of legal-administrative institutions, as well as towards the forms of their appropriation by social agents. In this article we address the causes of the success of human rights language, we analyze the limitations of a merely legal approach and the forced reorientation of the theme towards “the social life of rights”. We finally propose lines of research that highlight the contributions of ethnography to the subject
