La Iglesia del Monstruo del Espagueti Volador y las confesiones religiosas en el derecho español. Apuntes desde la jurisprudencia constitucional

Abstract

En octubre de 2020 la Audiencia Nacional falló acerca de la inscripción de la Iglesia del Monstruo del Espagueti Volador en el Registro de Entidades Religiosas de España. Con este motivo, el presente trabajo estudia el sistema de reconocimiento de entidades religiosas en el derecho español en relación con las directrices del Tribunal Constitucional, así como la posterior evolución normativa y jurisprudencial de dicho sistema de reconocimiento. A la luz de todos los elementos analizados, el artículo ofrece argumentos relativos a la inscripción de la Iglesia del Monstruo del Espagueti Volador, teniendo presentes la neutralidad del Estado y el principio de no discriminación.

In October 2020, the Spanish «Audiencia Nacional», a centralised court in Spain with jurisdiction over all the territory, ruled on the registration of the Church of the Flying Spaghetti Monster in the Registry of Religious Entities of Spain. On the occasion of that decision, this article studies the system of recognition of religious entities in Spanish law, in relation to the guidelines provided by the Spanish Constitutional Court, and the subsequent normative and jurisprudential evolution of the system. Considering all the elements analysed, the article provides arguments regarding the inscription of the Church of the Flying Spaghetti Monster, in accordance with the religious neutrality of the State and the principle of non-discrimination.
