Abstract
La ausencia de una regulación europea común en materia de responsabilidad civil derivada de actos de difamación se vincula con la especial relevancia de la reciente jurisprudencia del Tribunal de Justicia en ese sector. Particular atención recibe la eventual consideración de las legislaciones nacionales en materia de intromisión en los derechos de la personalidad restricciones a la prestación de servicios de la sociedad de la información en el mercado interior, el alcance de las limitaciones de responsabilidad de los prestadores intermediarios, así como la delimitación entre proveedores de alojamiento de datos y proveedores de contenidos.
Given the lack of harmonization within the EU regarding civil liability arising from defamation, the recent case law of the EU concerning the implications of the internal market in this area has become very significant. Relevant issues include the role of the country of origin principle in connection with the activities of information society services providers, the scope of the limitations of liability for Internet intermediaries established in the e-commerce Directive and the delimitation between content suppliers and providers of hosting services.
