Abstract
La presente tesis “El despido disciplinario en las relaciones laborales especiales y otras relaciones de trabajo con particularidades” trata, como su título expresa, sobre el despido disciplinario y las causas que lo justifican en las relaciones laborales especiales y en las relaciones laborales con particularidades: sanción disciplinaria que debe tener lugar con la necesaria seguridad jurídica tanto desde la perspectiva del empleador como del trabajador. Esta decisión del empresario constituye una materia del Derecho en permanente necesidad de estudio, revisión y actualidad, por sus trascendentes efectos jurídicos, sociales y laborales, que en el caso de las relaciones laborales especiales y otras relaciones de trabajo con particularidades, goza de mayor relevancia por la existencia de una variada y específica regulación normativa, que está a su vez afectada por el sentido e interpretación que realiza tanto la jurisprudencia como la diversa corriente doctrinal, que son necesarias conocer para resolver los diversos problemas técnicos que la aplicación del despido disciplinario a las relaciones laborales produce, ofreciendo soluciones coherentes y sujetas al derecho vigente...
The present thesis "Disciplinary dismissal in special labor relations and other labor relations with particularities" deals, as its title expresses, with disciplinary dismissal and the causes that justify it in special labor relations and in labor relations with particularities: disciplinary sanction that must take place with the necessary legal certainty from the perspective of both the employer and the employee.This decision of the employer constitutes a matter of law in permanent need of study, revision and actuality, due to its transcendent legal, social and labor effects, which in the case of special labor relations and other labor relations with particularities, enjoys greater relevance due to the existence of a varied and specific normative regulation, which is in turn affected by the meaning and interpretation made both by the jurisprudence and the diverse doctrinal current, which are necessary to know in order to solve the various technical problems that the application of disciplinary dismissal to labor relations produces, offering coherent solutions and subject to the law in force...
