El régimen jurídico de los pisos turísticos en la Comunidad de Madrid: hacia la mejora de la protección del usuario y de la calidad turística

Abstract

Las nuevas formas de hacer turismo vinculadas al fenómeno de la globalización y el uso intensivo de las tecnologías de la información y la comunicación (TICs) han propiciado la creación y el desenvolvimiento de los pisos turísticos como modalidad de alojamiento de esta clase que permite a los sujetos privados disponer de una estancia con la privacidad propia de un domicilio y con las facilidades características de un servicio de tal naturaleza. La normativa madrileña que regula dicha actividad, representada por el Decreto 79/2014, de 10 de julio, es objeto de un detallado análisis para, partiendo de su contexto normativo, determinar la adecuación de sus objetivos, contenido y alcance. Se considera especialmente, a este respecto, las limitaciones impuestas por la Directiva 2006/123/CE del Parlamento Europeo y del Consejo, de 12 de diciembre de 2006, relativa a los servicios en el mercado interior y su transposición al Derecho español; así como los pronunciamientos judiciales recaídos durante su vigencia.

The new ways of doing tourism linked to the phenomenon of globalization and the intensive use of information and communication technologies (ICTs) have led to the creation and development of tourist flats as a type of accommodation of this kind that allows private subjects to have a stay with the privacy of a home and with the characteristic facilities of a service of this nature. The Madrid regulations governing this activity, represented by Decree 79/2014, of 10 July, are the subject of a detailed analysis in order to, based on its regulatory context, determine the adequacy of its objectives, content and scope. Particular consideration is given in this regard to the limitations imposed by Directive 2006/123/EC of the European Parliament and of the Council of 12 December 2006 on services in the internal market and their transposition into Spanish law; as well as the judicial pronouncements handed down during its validity.
