Abstract
El presente trabajo tiene por objeto analizar uno de los momentos más delicados que acaecen en la causa liberalis que tiene lugar contra Virginia en época regia. Recaída sentencia de esclavitud, y con el objeto de evitar la afrenta del estupro, su paterfamilias decide dar muerte a su propia hija. En ese contexto nuestro objetivo será valorar la existencia de los posibles límites del ius vitae ac necis en el episodio de Virginia y, por tanto, concluir si estamos ante un caso de aplicación de este derecho.
The purpose of this study is to analyze one of the most delicate moments that occured in the causa liberalis that took place against Virginia during the royal period. Sentenced to slavery, and in order to avoid the affront of statutory rape, her pater familias decided to kill his own daughter. In this context, the objective will be to evaluate the existence of possible limits of ius vitae ac necis in the Virginia episode and, therefore, to conclude if we are before a case of application of this right.
