La nueva vida constitucional en 1869: entre (más) derechos y (menos) poderes

Abstract

La Constitución de 1869 marca un hito dentro de nuestra Historia Constitucional por ser el primer texto abiertamente progresista y liberal de toda la centuria, centrado en los derechos y no en los poderes, tanto en el aspecto cuantitativo como también en el cualitativo ―defensa, restricciones, límites, garantías de tales derechos―. En suma, una Constitución diferente que es obra de un poder nacional auténticamente constituyente y que diseña un escenario ciudadano e institucional más avanzado. Otra cosa será la puesta en marcha de este nuevo edificio político.The Constitution of 1869 marks a milestone in our Constitutional History for being the first openly progressive and liberal text of the whole century, focused on rights and not on powers, both in the quantitative and qualitative aspects ―defense, boundaries, limits, guarantees of such rights―. In sum, a different Constitution that is the work of a genuinely constituent national power and that designs a more advanced citizen and institutional scenario. Another thing will be the launch of this new political building.
