Régimen jurídico de la vivienda familiar

Abstract

Se analizan en el presente trabajo las especialidades de régimen que plantea la vivienda familiar en situación de crisis y de normalidad matrimonial. En particular, el régimen de codisposición de la vivienda regulado en el art. 1320 del Código Civil y la atribución del uso de la vivienda familiar en caso de separación o divorcio. Especial atención se presta a la problemática que genera la ejecución de la vivienda familiar.

This paper analyses the specialties of the regime that family housing offers in situations of crisis and marriage normality. In particular, the system of the disposition of the dwelling regulated in art. 1320 of the Civil Code and the attribution of the use of the family dwelling in the event of separation or divorce. Special attention is paid to the problems generated by the execution of family housing for debts default by the spouses.
