Abstract
Arbitraje y Derecho administrativo han tenido un difícil engarce desde sus inicios más tradicionales hasta hoy; a diferencia de lo que ocurre en la arena internacional donde el Estado y sus apéndices se desenvuelven cada vez con mayor soltura. El objeto de esta tesis es doble: (i) por un lado, verificar la compatibilidad del arbitraje administrativo con la Constitución Española para lo cual hemos diseccionado toda la jurisprudencia histórica del Tribunal Constitucional y, (ii) por otro, el papel que ha empeñado el Estado en el arbitraje internacional y, muy en particular, en el arbitraje de inversiones donde recientes resoluciones del TJUE han puesto en solfa la virtualidad del propio mecanismo de solución de conflictos entre inversor y Estado.
Arbitration and Public law have faced a difficult relationship since the most traditional beginnings until today; unlike the development of the States and the rest of the public sector in international arbitration, which are soaring their participation constantly. The purpose of this PhD is double: First, to verify the compatibility of administrative arbitration with the Spanish Constitution to do so we have reviewed the historic case law of the Constitutional Court regarding arbitration and, (ii) Second, the role of the States in international arbitration and, in particular, facing investment arbitration. Recently, some rulings of the CJEU have objected the legitimacy of dispute-resolution-mechanisms between investor and State.
