Abstract
En el presente estudio se aborda el posible tratamiento dispensando al sindicato minoritario en el ámbito de la jurisdicción social, más concretamente si la normativa española, al implantar un modelo que proclama la libertad sindical al tiempo que consagra un estatuto diferenciado mediante la técnica de otorgar una serie de prerrogativas a quienes alcancen la condición de representativo, medida en términos de audiencia electoral en las empresas, proyecta estas prerrogativas y con qué intensidad y alcance en la configuración de la garantía jurisdiccional social. Se trata, en definitiva, de analizar el protagonismo que se otorga al sindicato minoritario en contraposición al sindicato representativo en la configuración de proceso laboral.
The present study addresses the possible treatment of the minoritarian trade union in the context of social jurisdiction, more precisely, whether Spanish legislation, by implementing a model that proclaims freedom of association while establishing a differentiated status through the technique of granting a series of prerogatives to those who achieve the status of representative trade union, measured in terms of electoral audience in companies, projects these prerogatives and with what intensity and scope in the configuration of the social jurisdictional guarantee. In summary, it is a matter of analysing the protagonism granted to the minority trade union as opposed to the representative trade union in the configuration of the labour process.
